Terms & Conditions

1. Applicability

These general terms and conditions apply to all services offered by AKTIV GYM BV, located at Vlyminckshoek 6, 9100 Sint-Niklaas, Belgium (VAT: BE0535.555.905). By using our services, you agree to these terms.

2. Services

AKTIV GYM offers the following services:

  • Hybrid personal training (on-site and online)
  • Open Gym (free access to the gym)
  • Lifestyle and nutrition coaching
  • Body assessments (InBody and others)
  • Access to the digital member portal (training programmes, bookings, communication)

The exact description of services and prices (VAT included) can be found on our website or upon request.

3. Registration and Agreement

  • An agreement is established through registration via our website, email, or in person.
  • You must be at least 16 years old to register. Minors under 18 require parental or guardian consent. Guardian details are recorded on your account.
  • By registering, you agree to the processing of your personal data in accordance with our Privacy Policy.
  • AKTIV GYM reserves the right to refuse a registration without stating reasons.

4. Digital Portal

  • Members receive access to a personal digital portal where they can view their training programmes, make bookings, view invoices, and communicate with their coach.
  • Login credentials are personal and non-transferable.
  • AKTIV GYM reserves the right to block access in case of misuse.

5. Prices and Payment

  • All prices are communicated VAT included (21% for coaching, 6% for gym access/assessments, under Belgian law).
  • Payment is due in advance unless otherwise agreed.
  • Recurring payments are collected via SEPA direct debit. By signing a SEPA mandate, you authorise AKTIV GYM to collect amounts due from your bank account. Pre-notifications are sent at least 5 business days before collection.
  • In case of non-payment or direct debit rejection, we reserve the right to suspend access to our services.
  • AKTIV GYM may adjust prices. Existing members will be notified at least 1 month in advance by email.

6. Cancellation and Suspension

  • Training sessions can be cancelled or rescheduled with a minimum of 24 hours' notice.
  • Sessions cancelled without sufficient notice may be charged.
  • Subscriptions can be terminated according to the conditions described in the agreement. A notice period applies; billing continues until the planned end date.
  • Members can request a temporary suspension ("freeze") of their subscription for vacation, medical, or personal reasons. No invoices are generated during the freeze period.

7. Health Data

  • For personalised coaching, we may record health data such as InBody measurements, injury history, and lifestyle data.
  • This data is processed only with your explicit consent and is used exclusively for your coaching programme.
  • You can request deletion of this data at any time via your portal or by contacting info@aktivgym.be.

8. Liability

  • Training is at your own risk. AKTIV GYM is not liable for injuries that occur during or as a result of training, except in case of gross negligence or intent.
  • We recommend consulting a doctor before starting a training programme.
  • AKTIV GYM is not liable for loss, theft, or damage of personal belongings.

9. House Rules

  • Follow the instructions of trainers and staff.
  • Return equipment to its place after use.
  • Maintain good hygiene (bring a towel, wear clean footwear).
  • Aggressive, discriminatory, or disruptive behaviour is not tolerated.

AKTIV GYM reserves the right to deny access in case of repeated violation of these rules.

10. Intellectual Property

All content on the AKTIV GYM website and portal (texts, images, logos, training programmes, software) is protected by intellectual property rights. Reproduction without prior written permission is prohibited.

11. Privacy

We handle your personal data with care. Please see our Privacy Policy for more information on what data we collect, how we use it, and what your rights are.

12. Complaints Procedure

If you have a complaint, you can contact us at info@aktivgym.be. We will endeavour to respond to your complaint within 14 working days.

13. Applicable Law

Belgian law applies to these terms. Disputes are submitted to the competent court in the district of Dendermonde.
